What this solves
Germany's Ruhezeit is the #1 thing travellers get wrong. A drilling run at 21:00 in a Mietshaus is a complaint, a call to the Hausverwaltung, and possibly a €30–€80 Bußgeld. The same drilling at 11:00 on a Saturday is fine. This tool collapses the rules — federal Hausordnung plus state Mittagsruhe plus Sunday Rest — into a single verdict.
The other trap is hotel-room specific: many travellers don't realise that Waschmaschine in an apartment hallway is shared and strictly Sonntagsverbot. Washing on Sunday can get a private note from the Hausmeister. Booking a Sonntag-morning departure with a Waschmaschine cycle at 06:30 is a common mistake.
How to read the result
- "Allowed" = no Ruhezeit, no complaint expected. Zimmerlautstärke still applies (don't blast speakers).
- "Restricted" = within Ruhezeit windows. You can do the activity only at Zimmerlautstärke (room volume) and ideally with closed windows.
- "Forbidden" = strict Ruhezeit (Sonntagsruhe, Nachtruhe). Even Zimmerlautstärke is borderline — best to wait.
- "Fines" are typical Bußgeld range, per Ordnungswidrigkeitengesetz and local Bußgeldkatalog. Hausordnung fines are separate and per Mietvertrag.
- Complaint path: first informal note to neighbour → Hausmeister/Hausverwaltung → Ordnungsamt (Bußgeld) → Mieterbund/RAK (tenant legal).
Limitations
- Hausordnung (house rules) can be stricter than the state law and override it. Always check the rental contract or the Aushang in the stairwell.
- Children playing outside (Kindergeschrei) is legally exempt from Ruhezeit — but noise from ball games is not.
- Washing machine noise is treated as technisch, not as a Verkehrslärm, so the typical fines are low (€5–€30).
- Does not model Mietminderung (rent reduction) — if your neighbour is loud at 03:00 for weeks, you can withhold rent. This is a separate civil-law track.
- Berliner Nachtruheschutzbezirk and similar local designations exist; those rules override state rules but we don't model them at the address level.
FAQ
What is the typical fine?
Bußgeld for Ruhezeit violations ranges €5–€500 depending on severity and federal-state Bußgeldkatalog. The first warning is usually informal (Hausverwaltung). Persistent violations: €30–€80 for Waschmaschine, €40–€100 for drilling, €100–€500 for music.
Can my neighbour call the Ordnungsamt?
Yes. Any neighbour can file a Lärmbeschwerde with the Ordnungsamt. The Ordnungsamt has authority to fine for Ruhestörung under § 117 OWiG. In practice, only persistent complaints trigger a fine.
Can children make noise during Ruhezeit?
Yes — Kindergeschrei (children crying/playing) is exempt from Ruhezeit per case law (BGH). The exemption doesn't extend to balls, horns or scooters on a tile floor. Parents are still expected to minimise noise.
Is the Hausordnung legally binding?
Yes, once you sign the Mietvertrag. A stricter Hausordnung (e.g. Ruhezeit from 20:00) overrides state defaults. A more lenient one does not — federal Nachtruhe still applies as a minimum.
